Coconino County is the largest county in Arizona by land area, running from Flagstaff north to the Grand Canyon. When co-owners of Coconino County real property can’t agree on what to do with it, a partition action lets any co-owner ask the court to divide the property or order it sold. You don’t need the other owners’ consent to bring one.
It includes Flagstaff, Page, and Williams.
These cases usually involve siblings who inherited a home together, unmarried partners who bought property jointly, or investment partners whose plans diverged. They resolve in one of a few ways:
- Sale. The court orders the property sold and the proceeds divided in proportion to ownership — the most common outcome in Arizona.
- Division in kind. If the land can be split fairly — more realistic with acreage than a single house — each owner receives a separate, titled piece.
- Buyout. One owner buys out the others in a private agreement that avoids a court-ordered sale.
- Accounting. The court can adjust each owner’s share for unequal payment of the mortgage, taxes, insurance, or improvements.
