Lake Havasu City Partition Attorney

Lake Havasu City is in Mohave County, so a partition action over Lake Havasu property is filed in Mohave County Superior Court. Any co-owner can ask the court to divide the property or order it sold, without the other owners’ consent.

Lake Havasu properties are often second homes or vacation homes, and co-owners frequently live in California or other states. That doesn’t prevent a case: it is filed in Arizona where the property is, and out-of-state owners can be served and take part remotely. Common situations include:

  • Families who share a lake home and disagree about selling, renting, or using it
  • Heirs spread across several states who inherited a property together
  • Co-owners in dispute over who has been paying for upkeep, taxes, and insurance

These cases resolve in one of a few ways:

  • Sale. The court orders the property sold and the proceeds divided by ownership share. This is the most common outcome in Arizona.
  • Division in kind. If the land can be split fairly, each owner receives a separate, titled piece. This is more realistic with acreage than with a single house.
  • Buyout. One owner buys out the others in a private agreement, avoiding a court-ordered sale.
  • Accounting. The court can adjust each owner’s share for unequal payment of the mortgage, taxes, insurance, or improvements.
